Regularisation

A regularisation application is a retrospective application for permission relating to previously unauthorised works started on or after the 11 November 1985. Where works are carried out without first submitting a relevant Building Regulation application or without notifying the Council, the owner may be prosecuted under the Building Act 1984 for the unauthorised work. However, to facilitate people who wish to have work approved, there is a process called Regularisation. The purpose of the process is to regularise the unauthorised works and obtain a certificate of regularisation. Depending on the circumstances, exposure, removal and/or rectification of works may be necessary to establish compliance with the Building Regulations.

Application forms for this purpose are provided for you to print and should be submitted with the same information as for a full plans application including the relevant charge (which is individually assessed but is generally higher than for standard applications). Please e-mail bcinfo@midsussex.gov.uk providing details of the work together with a request that the charge be determined. This type of application is exempt from VAT. (Value Added Tax)
